Abstract: | Avoidance serves as an aggrieved party's most serious remedy. It is not a suitable remedy, except in exceptional situations. In light of CISG-AC Opinion No.5, this paper compares the circumstances under which avoidance of contract may take place under CISG and PICC, and explores how uncertainties arising from the principle of fundamental breach can be tackled. |
